Ladies and gentlemen, 
 
Please find below the decision of the Brussels Court of Appeal which overturns the courageous decision taken last 
May by the Belgian Data Protection Authority to prohibit the transfer of tax data of Belgian accidental Americans to 
the United States . 
 
As you can imagine, I find this real y regrettable because it is now obvious that these data transfers are not 
compatible with the GDPR. 
 
The document revealed last week by Politico clearly shows that member states are stil  wondering whether their 
bilateral agreements contain the necessary guarantees to comply with Article 46 of the GDPR. To date, none have 
fol owed up on the declaration adopted by the EDPB (and therefore al  protection authorities) on April 13, 2021. 
Which is very revealing. Justice postponed, Justice denied. 
 
It would not be so serious if it did not impact the fate of more than 300,000 European citizens who see their rights 
violated every year. 
 
At the end of May 2023, I sent you an official complaint so that you can open an investigation. I renew my request 
and invite you to open an investigation without further delay so that politics does not take precedence over justice. 
 
In the hope of receiving a favorable response from your institution, I remain at your disposal for any further 
information.
