Please be informed that the English translation of the decision 61/2023 rendered by the BE SA’s Litigation Chamber 
with regards to the FATCA complaint is now available on our website.   
 
We also take this opportunity to inform you that the Belgian Ministry of Finance (or FPS Finances) has requested the 
suspension and the annulment of the above-mentioned decision before the Brussels Court of Appeal (Market 
Court). By interlocutory judgment 2023/5139 of 28 June 2023, the Market Court decided to suspend the BE SA’s 
decision.         
 
The hearing before the Market Court on the request for annulment should take place in November and a judgment 
can be expected in January 2024. 
 
We shal  of course keep you informed of developments in the file and remain at your disposal should you have any 
questions on the above.
