Dear Swedish Meteorological and Hydrological Institute,

please send to me all EFAS (European Flood Awareness System) notifications that were sent to national authorities from 10 to 14 July regarding the Rhine and Meuse River basins in Germany. There should be more than 25 such notifications (see https://emergency.copernicus.eu/mapping…)

Dear Arne Semsrott,

SMHI has been sending out EFAS notifications as part of its tasks of the EFAS Dissemination Center which is a service provided through a framework contract with the Joint Research Center of the European Commission.
Access to EFAS notifications should therefore be requested to the European Commission, responsible for the European Flood Awareness System EFAS.

Note that EFAS forecast data including a list of archived flood notifications are in any case publicly available after a period of 30 days.

However, according to directive 2003/4/EC on public access to environmental information I have the right to access information "held by public authorities". The requested information is, without a doubt, held by your institution and therefore have to be disclosed. Following the request below: I have been in touch with our Chief Legal Officer and SMHI has taken the decision to divulge the information asked for, in accordance with the Swedish law.
Please see below the motivation from our Chief Legal Officer.

According to the Swedish Constitution, a Swedish governmental agency must handle a request addressed to the agency in accordance to the Constitution and supplementary Swedish law.
Should the procedure being regulated by an agreement, such as the framework contract for EFAS, and there is a conflict between the Swedish Constitution and the framework contract, the Swedish Constitution will prevail.
Consequently, the party asking for information and/or documents at the Swedish agency doesn't have to act in accordance with the stipulation in the framework agreement, but relay on the Swedish Constitution and supplementary law.
This condition have been also explained in the e-mail dated 06-07-2021 as response to "JRC/IPR/2020/OP/3195 - CEMS FLOOD dissemination centre - Contract for signature - Ares(2021)4025951".
